Why does mediation work?
Mediation works because the parties want it to.
It enables them to escape the situation where each of them battles through a lawyer who ‘fights their corner’. In mediation the parties are working together towards a common goal – to find a solution acceptable to both, with minimum cost, stress and anxiety. By keeping their dispute in mediation they can work together with their mediator to find a lasting, constructive and practical solution to their problem.
Because the result is of their mutual choosing, therefore they do not feel that they have been pushed into it or had it imposed upon them. They buy into the solution because they came up with it and are willing to cooperate with its implementation because it is the solution they have chosen for themselves.
